Terms of Service

1. Agreement

By using POWER MEMORY ("the Service"), you agree to these Terms. If you don't agree, don't use the Service. Simple as that.

2. The Service

POWER MEMORY is a Memory as a Service platform. We provide encrypted memory vaults that AI platforms can read from and write to via the MCP protocol, and a web dashboard for manual memory management. The Service is currently in beta.

3. Your Account

You need a valid email address to create an account. You are responsible for maintaining the security of your API keys. If you suspect unauthorised access, revoke your keys immediately from the dashboard and contact us.

4. Your Data

You own your memories. We don't claim any rights to the content you store. We encrypt your data at rest and don't read, analyse, sell, or share your memories with anyone. See our Privacy Policy for full details.

5. Acceptable Use

Don't use POWER MEMORY to:

• Store illegal content or content that violates others' rights

• Attempt to access other users' data

• Abuse the API with excessive requests designed to degrade service

• Reverse engineer, scrape, or attack the infrastructure

• Use the service for spam, phishing, or malicious purposes

• Store API keys, credentials, passwords, or other secrets from third-party services

• Circumvent rate limits or technical access controls

• Impersonate other users or misrepresent your identity

We reserve the right to suspend accounts that violate these terms.

6. Free Tier

POWER MEMORY offers a Free tier (100 memories) and a Pro tier (£4.99/month or £49.99/year). Early adopter pricing is locked for the first 100 users. Free tier users retain access to their existing memories. We'll give at least 30 days notice before any pricing changes.

The Service is provided on a best-effort basis. We do not guarantee uptime or offer a formal Service Level Agreement (SLA) at this time. See Section 7 (Availability) for details.

7. Availability

We aim for high availability but don't guarantee 100% uptime. The Service is provided "as is" during beta. We'll do our best to notify users of planned maintenance.

8. Limitation of Liability

To the maximum extent permitted by law, POWER MEMORY is not liable for indirect, incidental, or consequential damages. Our total liability is limited to the amount you've paid us in the 12 months before the claim (which may be zero on the Free tier).

9. Termination

You can delete your account at any time from your dashboard (Security → Danger zone) or by emailing us at contact@powermemory.ai. We can terminate accounts that violate these terms with notice. Upon termination, your data is permanently deleted within 30 days.

10. Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales.

11. Changes

We may update these terms. We'll notify registered users of material changes via email at least 14 days in advance. Continued use after changes take effect means you accept the new terms.

12. Trademark Disclaimer

POWER MEMORY is an independent third-party service. It is not affiliated with, endorsed by, sponsored by, or otherwise associated with any AI provider.

Claude (Anthropic, PBC), ChatGPT (OpenAI, Inc.), and Grok (xAI Corp.) connect via the Model Context Protocol; Gemini (Google LLC), Microsoft Copilot (Microsoft Corporation), and Perplexity (Perplexity AI, Inc.) connect via the PowerMemory Chrome extension. We reference these names only to describe compatibility (nominative use).

POWER MEMORY uses the Model Context Protocol (MCP), an open standard maintained by the Agentic AI Foundation under the Linux Foundation. Our implementation is independent and does not represent any endorsement by Anthropic or the MCP project maintainers.

All other trademarks are the property of their respective owners.

13. Data Processing & Jurisdiction

POWER MEMORY is operated from the United Kingdom. Service infrastructure, including memory vaults and authentication servers, is hosted in the European Union (Germany, via Contabo GmbH).

Data Controller: You are the Data Controller for the personal data you store in your memory vault. POWER MEMORY acts as Data Processor on your behalf.

GDPR compliance: We process personal data in accordance with the UK GDPR and EU GDPR. You retain full rights of access, rectification, erasure, and data portability. You can export or delete your entire vault at any time from your dashboard.

ICO registration: POWER MEMORY is registered with the UK Information Commissioner's Office (registration number C1909512).

Subprocessors: We use Contabo GmbH (infrastructure hosting, Germany), Cloudflare (edge CDN and DNS), and Resend (transactional email delivery). We do not share memory vault contents with any subprocessor — only encrypted database files transit infrastructure providers.

Data retention: Your data is retained while your account is active. Upon account deletion, your encrypted vault is permanently removed after a 14-day grace period — and in any event within 30 days. We do not retain backups beyond operational necessity.

14. Browser Extension

The PowerMemory browser extension is an optional client that connects to the same vault as our web app. By installing the extension, you additionally agree to the following:

  • The extension is in beta. UI and features may change as we iterate. Breaking changes will be communicated in release notes on the Chrome Web Store listing and at github.com/PowerMemoryHQ.
  • The extension reads content from supported AI platform pages (Google Gemini, Microsoft Copilot, Perplexity) only on your explicit action. Claude, ChatGPT, and Grok integration is handled separately via MCP connectors, not via this extension. You are responsible for not saving content that violates the Acceptable Use clauses (Section 5).
  • Don't redistribute, repackage, reverse engineer, or use the extension to harvest content from AI platforms in violation of those platforms' Terms of Service.
  • The extension uses OAuth 2.1 with PKCE for authentication. You can revoke extension access at any time from your dashboard. We can revoke individual extension installs that violate these terms.
  • Source code distribution: the extension's bundled JavaScript is minified for size. Source maps are available on request via contact@powermemory.ai.
