Terms of Service

1. Agreement

By using POWER MEMORY ("the Service"), you agree to these Terms. If you don't agree, don't use the Service. Simple as that.

2. The Service

POWER MEMORY is a Memory as a Service platform. We provide encrypted memory vaults that AI platforms can read from and write to via the MCP protocol, and a web dashboard for manual memory management. The Service is currently in beta.

3. Your Account

You need a valid email address to create an account. You are responsible for maintaining the security of your API keys. If you suspect unauthorised access, revoke your keys immediately from the dashboard and contact us.

4. Your Data

You own your memories. We don't claim any rights to the content you store. We encrypt your data at rest and don't read, analyse, sell, or share your memories with anyone. See our Privacy Policy for full details.

6. Free Tier

POWER MEMORY offers a Free tier (100 memories) and a Pro tier (coming soon — $4.99/month or $49.99/year). Free tier users retain access to their existing memories. We'll give at least 30 days notice before any pricing changes.

The Service is provided on a best-effort basis. We do not guarantee uptime or offer a formal Service Level Agreement (SLA) at this time. See Section 7 (Availability) for details.

7. Availability

We aim for high availability but don't guarantee 100% uptime. The Service is provided "as is" during beta. We'll do our best to notify users of planned maintenance.

8. Limitation of Liability

To the maximum extent permitted by law, POWER MEMORY is not liable for indirect, incidental, or consequential damages. Our total liability is limited to the amount you've paid us in the 12 months before the claim (which may be zero on the Free tier).

Ask Your Vault (optional, bring-your-own-key)

Ask Your Vault is an optional feature that, when you use it, sends memories you select — on your own AI API key — to a third-party AI provider (via OpenRouter) to answer your question. If you use it:

• Your key, your cost, your account. You supply and are responsible for your own OpenRouter API key, all charges it incurs, and staying within your own spending limits. We do not pay for, and are not responsible for, your usage costs.
• Two ways to connect your key. You can connect your OpenRouter key in two ways: paste it, or authorize PowerMemory on OpenRouter ("Connect OpenRouter"). If you authorize, OpenRouter creates a new API key on your account and sends it to our server; we hold it exactly as we hold a pasted key — in memory, for your session, never written to disk. That key remains yours and stays on your OpenRouter account: clearing it here only makes us forget it. To destroy it, delete the key that OpenRouter created for PowerMemory at openrouter.ai/settings/keys (it will carry our name; Ask Your Vault shows you its exact label once you have connected). OpenRouter's authorization screen offers an optional credit limit — we cannot set it for you, and if you leave it blank your key may have no spending limit. We check after connecting and tell you which it is.
• Provider terms apply downstream. Once your request reaches OpenRouter and the model provider you choose, their terms and privacy practices — not ours — govern how they handle it. You are responsible for reviewing and complying with those terms.
• Output may be wrong. Answers are generated by a third-party AI model and may be inaccurate, incomplete, or misleading. This applies to any summaries, analysis, or explanations of apparent conflicts between your memories. Do not rely on Ask Your Vault output as a sole basis for decisions; verify anything important against your actual memories.
• Read-only. Ask Your Vault reads the memories you scope in order to answer; it cannot add to, change, or delete anything in your vault.
• Optional and opt-in. The feature is off by default and requires your separate, withdrawable consent before it will send anything. It is not required to use the rest of PowerMemory.

9. Termination

You can delete your account at any time from your dashboard (Security → Danger zone) or by emailing us at contact@powermemory.ai. We can terminate accounts that violate these terms with notice. Upon termination, your data is permanently deleted within 30 days.

10. Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales.

11. Changes

We may update these terms. We'll notify registered users of material changes via email at least 14 days in advance. Continued use after changes take effect means you accept the new terms.

12. Trademark Disclaimer

POWER MEMORY is an independent third-party service. It is not affiliated with, endorsed by, sponsored by, or otherwise associated with any AI provider.

Claude (Anthropic, PBC), ChatGPT (OpenAI, Inc.), and Grok (xAI Corp.) connect via the Model Context Protocol; Gemini (Google LLC), Microsoft Copilot (Microsoft Corporation), and Perplexity (Perplexity AI, Inc.) connect via the PowerMemory Chrome extension. We reference these names only to describe compatibility (nominative use).

POWER MEMORY uses the Model Context Protocol (MCP), an open standard maintained by the Agentic AI Foundation under the Linux Foundation. Our implementation is independent and does not represent any endorsement by Anthropic or the MCP project maintainers.

All other trademarks are the property of their respective owners.

13. Data Processing & Jurisdiction

POWER MEMORY is operated from the United Kingdom. Service infrastructure, including memory vaults and authentication servers, is hosted in the European Union (Germany, via Contabo GmbH).

Data Controller: You are the Data Controller for the personal data you store in your memory vault. POWER MEMORY acts as Data Processor on your behalf.

GDPR compliance: We process personal data in accordance with the UK GDPR and EU GDPR. You retain full rights of access, rectification, erasure, and data portability. You can export or delete your entire vault at any time from your dashboard.

ICO registration: POWER MEMORY is registered with the UK Information Commissioner's Office (registration number ZC124021).

Subprocessors: We use Contabo GmbH (infrastructure hosting, Germany), Cloudflare (edge CDN and DNS), and Resend (transactional email delivery). We do not share memory vault contents with any subprocessor — only encrypted database files transit infrastructure providers.

Data retention: Your data is retained while your account is active. Upon account deletion, your encrypted vault is permanently removed after a 14-day grace period — and in any event within 30 days. We do not retain backups beyond operational necessity.

14. Browser Extension

The PowerMemory browser extension is an optional client that connects to the same vault as our web app. By installing the extension, you additionally agree to the following:

• The extension is in beta. UI and features may change as we iterate. Breaking changes will be communicated in release notes on the Chrome Web Store listing and at github.com/PowerMemoryHQ.
• The extension reads content from supported AI platform pages (Google Gemini, Microsoft Copilot, Perplexity) only on your explicit action. Claude, ChatGPT, and Grok integration is handled separately via MCP connectors, not via this extension. You are responsible for not saving content that violates the Acceptable Use clauses (Section 5).
• Don't redistribute, repackage, reverse engineer, or use the extension to harvest content from AI platforms in violation of those platforms' Terms of Service.
• The extension uses OAuth 2.1 with PKCE for authentication. You can revoke extension access at any time from your dashboard. We can revoke individual extension installs that violate these terms.
• Source code distribution: the extension's bundled JavaScript is minified for size. Source maps are available on request via contact@powermemory.ai.
